Chief Justice

Sir,
President Iajuddin Ahmed yesterday appointed M M Ruhul Amin as the next Chief Justice (CJ), superseding Justice Mohammad Fazlul Karim, the most senior member of the Appellate Division of the Supreme Court after the incumbent CJ. We thought this would not happen again, especially with a neutral caretaker government. The nation is always against the superseding of judges.

People with little or knowledge of history of Ottoman Empire should not be issuing their Verdicts on big issues like these.
 
FACTS:
 
1. Once mighty Ottoman Empire had ruled up to Central Asia.
2. It had later also extended up to Morocco.
3. It had also ruled Greece, Yugoslavia, Austria, Hungary, Romania, parts of Poland and Italy.
But before birth of Kamal ata Turk, ...
 
* Ottoman Empire had lost all European Colonies.
* Ottoman Empire had sided with Hapsburg Hungro Austrian Empire in the WW I and had lost.
* All Arabic Speaking nations of Ottoman Empire from Morocco to Gulf had revolted against the Caliph of Ottoman Empire and had become agents of Great Britain and France declaring themselves independent.
* Ottoman Empire was already dead, Greek and Indian British Army (of which half were Punjabi Moslims) had invaded Turkey and conquered half of it, when General Mostafa Kamal stood up in their way, gathered retreating Turkish Troops and attacked back to defend his country against the wishes of Caliph, who had become a puppet of British.
* Kamal became a hero of Turkey, when he successfully made Greek and Indian British Army leave Turkey.
* The Caliph had refused authority of General Kamal therefore, he had exiled him to Italy, where he lived happily ever after on British Pension.
* Mollaas of 'Ikhwanol Moslimeen' tried to assassinate Kamal and then they had tried to overthrow him so, he had slaughter about a thousand of them.
* Kamal's hate for Arabs had increased so much that he had switched Turkish Language from Perso-Arab (same as Urdu) Script to Roman Script.
* Kamal had wanted to eradicate all effects of Arabs, who had forgotten that Turks are also Moslims and had slaughtered them from Morocco to Arabia mercilessly during revolt against the Caliph but he didn't succeed. He had tried to change Nmaaz in to Turkish language Nmaaz and Azaan also.
 
MISMANAGEMENT OF OTTOMAN EMPIRE BY CALIPHS:
 
1. Caliphs had no Administrative or Economic Sense.
2. They used to become Caliphs because they were the ones of the Princes, who were good in Palace Intrigues, not the ones, who knew, how to run the Empire.
3. Administrative Mismanagement led to fall of Empire from Central Asia to Persia.
4. Economic Mismanagement led to heavy Gold Coin borrowing from Merchants of Venice, Italy because there was no IMF and World was run on Gold Standard in those days.
5. Loan Defaults had caused Merchants of Venice become the authoritative Tax Collectors of the Empire because how else could they loan more without recovering that they had already loaned?
6. Caliphs had become Puppets of Mollaas and in the beginning they had even resisted new Weapons for the Army because Mollaas had declared that it was against Islam to use the new Invention of Cannons and Rifles.
7. Mollaas had first Medical University of the world dismantled Brick by Brick because they had declared the method of its Teaching un-Islamic. The Caliph had agreed.
8. Teaching of Astronomy, Physics, Chemistry, Anatomy, Biology etc were declared un-Islamic by the Caliph listening to Mollaas. The Reason was, that all books on these subjects were written by Moslim Scientists, who had already been declared Kaafir and were executed on Edicts of Mollaas. Their books were banned though some of such Infidels had escaped to Italy and had been offered jobs in European Universities. All such banned books of Science were being translated in Europe and taught to leave Moslims behind in Sciences.
9. Almost all the later Caliphs of Ottoman Empire were illiterates and didn't understand any Sciences.
10. Almost all later Caliphs were rather more like illiterate Politicians than educated smart leaders with knowledge and Vision.
 
There's a lesson to learn from this story instead of blindly backing a Caliphate for all Moslims of the world. 'A Momin can not be stung out of same hole twice'  (the Holy Prophet to Hzt. Abu Bakr after he was bit by a Snake, while he was asleep in cave escaping or on his way to Medina 622 A.D.).

I agree.
Phrase, 'US-occupied Moslim Country' is used so frequently by Mollaas and Mollaanis like none of us know the reality. US Army is still in some European Countries and Japan since WW II is anybody calling the 'US-occupied Countries' or are they not free?
 
If being fools the JehaaDis keep attacking US Army, it would definitely retaliate. Why you created such circumstances that US Army landed in your countries to start with and why are you creating such circumstances in Pakistan now by keep sending your Suicide Bombers to kill Pak Army Soldiers and other innocent people?
 
Because you are ignorant illiterate JehaaDis, not because you are more Moslims than us. Similarly, you have put a lot stuff on Internet to prove US Army is killing your people like we do not know, what your people are doing to US Army. 
 
You tell us that US Army has killed more Moslims than your Terrorists have killed, when its just the reverse. In Sunni-Shiyah in-fighting has killed many times more Iraqis than US and her allies have. Moslim Countries themselves have killed millions of their own in last half century than any Non Moslims. How do you know they were criminals?  Please fear Allah and heed His warning against spreading falsehood and speculation (17:36).  You don't know them, nor do you know the "crime" they committed.  In fact, ever since the true butcher Khomeini came to power and brutalized the Iranian people, I have hardly seen any "justice" done by the idol worshiping, stupid, totally Qur'an-illiterate theocratic morons. 
 
I don't know anything about the 'crime' these men committed because there is no information available in the video, but I can tell from the way these brutal, cruel, unscientific hangings were conducted that perhaps no proper channels of justice were never followed, nor was any scientific and civilized way of taking a human life was pursued if at all the 'crime' was proven against them.

Making sure that the changes are stable - ACC can help CTG with the dillema
The current interim government is implementing a lot of reforms, taking many decisions that was unimaginable for a long time and we are hoping these changes will pay divident for the nation in coming days. But there is a IF. Government is also aware of the IF. The IF concerns the stability of the system in the new state. Any social or political changes needs time to make the adjustment for a changed policy. However, the changes that are being implemented in the last two years, these are proving too much for our politicians and traditional elites of the society. So the concern of IF points to the concern that weather it will reverse.
 
Off course, if things reverses, it will have a degenerative effect on the social progress - as opposed to the regenerative effect that many of us are expecting. The concern becomes more serious when one thinks of the implication of that effect on our lives of corrupt politicians. Certainly, that would pave the way for many of jailed or absconding politicians a promise of good old days which is dangerous for the society. Before going into the detail of our topic today, lets take a look at the scorecard of current government.
 
Someone in another forum listed the scorecard of this government as follows:
 
Some of their successes:
#1. National ID
#2. Voter List
#3. Chittagong Port
#4. Separation of Judiciary
#5. Development of Dudok, EC, PSC
#6. Arresting Godfather & Godmothers
 
 
Some of their failures:
#1. Failure to control commodity price
#2. Failure to clean corruption from own organs like police
#3. Failure to give comfort to the honest businessman
#4. Failure to estabilish strong allegation against the Godfather and Godmother held behind the bar.
#5. No control over power sector and trasnport sector
#6. Failure to focus on reduce the widespread "vejal" in consumers goods (we add this)
#7. Failure to making the mess in private universities at a manageable level (we add this)
#8. Failure to introduce a merit and performance based promotion criteria in public service including the co-opting senior buerucrats from the private, semi-government sectors by introducing a separate selection body for policy making level (we add this)
#9. Failure to declare the elected posts competitive with other jobs with similar stress by declaring them as professional posts (we add this)
#10. Failure to act decisively to capture and punish the alleged war criminals by holding tribunals (we add this)
 
The #1 and #10 failure are a result of many factors including deficiencies in timely actions of the government and its perceived risk-averse nature, inexperience and lack of understanding of politics, among many others. However, all other failures can be traced to or generalised as one single failure. That is the government's explicit or implicit decision to leave the major part of the buerucracy out of scope. In other words, the top bosses at the secrertiats are holding on those reform proposal by using a number of tactics. Any lay person can imagine that the favourite tactic of these culprits will be delay things as long as possible - long enough to expire the tenure of the government. And their counterparts in the political parties are making sure that govermnet has a solid expiry date and they have done it very well from the very beginning. Why? A number of factors have led to this situation. The government of Dr. Fakhruddin Ahmed is also aware of this. But what they are doing about it? Or are they doing anything?
 
To our judgmement, this is one of most important policy decision that this government is facing. How to balance the need of doing enough vs. doing too much?
 
So far, it seems the government has made a policy decision about not touching the buerucracy (or touch minimally). They are hoping that this policy would help the system to maintain stability over the near term. 50 ministers needs 50 secretaries - isn't it? They are ready to catch all the 50 ministers, but not all the 50 secretaries. Why? Also, since they do not want to touch the 50 secretaries, they will not be able to convincingly prove any of the cases against the ministers. And that is the real problem as far as long term stability is concerned. CTG is actually hurting the stability - if they decided not to touch bureacracy for the sake of stability! A dillema - isn't it?
 
This policy - if it were taken conciously - has also weakened the overall stability. How - would you ask? Let us clarify.
 
The degeneration - if that happens - would start with the relatively weak cases being pursued against the political leaders. Some of these cases are so weak that it might give a perception that the cases are politically motivated - as opposed to the criminal cases as they are being projected now.
 
How did that happen?
 
Since government did not engage the corrupt members of the buerucracy to the full extant, there was not much option but file weak cases. A minister does a corruption with the help of a secretary OR the prime minister did a corruption with the help of a cabinet secretary. Now if those secretaries are still part of the government, how could a strong case be made against the politicians.
 
We are not sure the merit of this compromise in the context of national interest. Its true the burecracy is important for continuity of the policy changes, but that should not come at the cost of 'wrong perception' of politically motivated cases. If you give 13 years to a minister for corruption in a certain ministry, that should implicate the secretary of the same ministry for at least 7 years - general people would expect that.
 
This is a balancing act that government has to re-assess again. No policy decision should be static - all should be addressed dynamically. The only thing that should stay as static is the long term good governance of the country, national interest and goodwill of the general people of Bangladesh. Anything - that increases the possibility of long term good governance of the country, it should not left un-addressed.
 
So, is there anything specific that we are proposing for the government to do, as we usually do in our articles? Yes, we want to propose something. But unlike many of the articles, this particular proposal isn't for the government, per se. It is for the ACC. We hope when the ACC government returns from the much needed personal time-off for him, he would focus on to do some stretching - show some teeth. ACC should unearth some new cases or evidences that creates chasm for the government. Embarrass the government - lets see how it deals with that. We hope Mr. Chairman will do justice to his reputation. We all have two opposing side in our character. In this context, it can be safely said that Mr. Chairman wasn't selected to the Army Chief position during his service to the nation for the reputation of being straight-forward, to the point and honest. To the political government, it was his natural tendency to oblige seniors to the fullest extant which made you an attractive choice. Now is the time to prove this perception wrong. Show some evidence of your reputation that exists among general people and general soldiers. The position that you accepted as ACC chairman does not have any use of your qualities of following order. This position needs your other qualities which is being straight forward, being to the point and being honest. Now is the time - the nation will be watching!

To supercede the seniors by the juniors with blessings of the rotten political thugs
is  thugs practice was there since paki era wherein the then E. pakistani bangalee officers were deprived of their due right.
The same thing happened very shamelessly by the then Sheik Mujibs BAL government. Sayed Hossain,the brother-in-law of Mujib who was an ordinary section officer in then E.pak govt was made Joint Secreatry overnight and posted in the Ministry of cabinet division. This blighter clerk made havoc and made the life of the senior most CSPs repatriated from pakistan. By thus made  the sanctity of the administration ludicrous. There are several hundreds of supresetion cases during BAL's three years` terrorising rule. In the second term of BAL's rule recurrence of such incidents happened. The notable one is to appoint a dead(retired) general to hold the post Chief of staff of Army. This was not only shameless but also breaking all the norms of defense Service.
 
The tragedy is that none of the people who are now objecting  to the CTG's present so-called wrong action raised their sane(??) voice against thier party BAL's unethical actions.
 
IS IT NOT ANOTHER UNETHICAL ACT OF THE SUDHIJONS INCLINED TO BAL ? THIS IS NOT ONLY DISDAINFULL BUT STUPID AS WELL ?

     Poor salary in the government services are creating many problems that we could otherwise avoid.  I do not understand as to why government is shying away from this very important national issue. Present salary strucure can not attact bright young talents to  government service.  The country is now being run by the mediocres  and will continue to be run by them unless the salary issue is satisfactorily resoved.

While the nation is always against the superseding of judges, particularly when this government is a neutral caretaker government. We did not expect from this government will go for supersession like previous political governments. Who has given the present government such an audacity to disgrace the senior judge as the present government has forgotten to let go of their attachment to being right, and suddenly their mind is more open and the government is able to benefit from the unique viewpoints of others, without being crippled by its own judgement?

Marraige is universal but the history of marraige has undergone certain reforms to make it bindings on both the paries to adehere to it's oath. During the reign of the kings and the Emperors there existed certain rules as for the marraige of the Nobles.
The kings/queens could not marry the commoner or from any other faith other than h/her own.
 
In the mordern era the governments also put some restrictions on marraige of the officials who holds position wherein dealing the national secrets.This restriction does in no way falls under the purview of violation of HR or obsacles to individuals personal freedom. It is welknown that while taking up such jobs the incumbents are well aware of the do's and dont's of the specialized service. So upon entry s/he is not entitled to any consideration of sentimental isues of love etc. here the national interest must be adhered to.
 
 
I am wondering that as the days are passing by Bangladesh is on the making of hundreds of examples of exemption overriding the rules paving the way of making fun out of the gravity of law. This wil surely have long lasting effect on the image of Bangladesh. It has`become a routine matter to make exception on he basis of connection and influence
 
To my opinion the recent "Premer Upakhkhan"( ISMAT JAHAN) of a lady Diplomat of our country should not have been considered on any pretext violating the long practiced rule of business of Foreign Service Cadre. Such indulgence has`surely undermined the sanctity of the country's existing rule resulting in future violations.
The concerned Diplmat should been asked to vacate the job and chose her own personal peace.
 
Finally I would like to quote from the writing of renowned columnist Minar Rashid about restriction as imposed by the US`governments on it's employees of diffeent cadres of sensetive nature. Quote :
 
"All U.S. citizen Foreign Service employees from State, AID, Commerce, Agriculture, IBB, and all other Department of State employees or contractors with sensitive duties who intend to marry a foreign national employee must inform the employing agency within 120 days prior to the expected date of marriage. If an employee has not heard back from DS after 120 days, AFSA suggest the employee contact DS to find out the status of the matter. Do not assume that everything is alright if DS hasn't provided a response within 120 days. Even if an employee has complied with the reporting requirements, there may be concerns with the employee's intended spouse or the spouse's family that could affect the employee's security clearance. Thus, it is better to err on the side of caution and check back with DS before proceeding with the marriage. Special Compartmented Information Access." Unquote
