বগুড়া, এপ্রিল ১৬ (বিডিনিউজ টোয়েন্টিফোর ডটকম)- বাবার বিরুদ্ধে যুদ্ধাপরাধের অভিযোগ এনে তার বিচার দাবি করেছে তিন সন্তান। এ দাবিতে বুধবার বগুড়া প্রেসক্লাবে সংবাদ সম্মেলন করেছে তারা।

সন্তানদের অভিযোগ, তাদের বাবা বগুড়ার ব্যবসায়ী ওসমান বিহারী একাত্তরে রাজাকার ছিল। এখনও ক্ষমতার দাপট দেখিয়ে চলছে।

সংবাদ সম্মেলনে ওসমান বিহারীর মেয়ে শবনম খান বলেন, "আমার বাবা এক জন যুদ্ধাপরাধী, নারী নির্যাতনকারী। এই ঘৃণায় তার সঙ্গে আমরা সম্পর্ক পর্যন্ত রাখিনি।"

এ সময় শবনম খানের সঙ্গে ছিলেন তার ভাই তারেক হাসান পাপ্পু ও বোন জেনিফার।

লিখিত বক্তব্যে শবনম খান বলেন, "আমার বাবা ওসমান বিহারী বগুড়ার প্রথম সারির রাজাকার ছিল। একাত্তরে তিনি যে দাপট দেখিয়েছিলেন, এখনও সে দাপট দেখিয়েই চলেছেন। মেয়ে হয়েও এক জন স্বাধীনতাবিরোধী কুলাঙ্গার পিতাকে ঘৃণাসহ তার বিচার এবং গ্রেপ্তার দাবি করছি।"

ওসমান বিহারী তার অপর স্ত্রীর সন্তানদের নিয়ে এখনও শবনম খানদের ওপর নির্যাতন চালাচ্ছে বলে সংবাদ সম্মেলনে অভিযোগ করা হয়।

শবনম খান বলেন, "বাবা এবং অন্য মায়ের সন্তানরা সশস্ত্র সহযোগীদের নিয়ে আমার স্বামী জাবেদ খানের ব্যবসা প্রতিষ্ঠান থেকে তাকে উচ্ছেদের জন্য প্রাণনাশের হুমকি-ধমকিসহ দিয়ে আসছে। গত ১৩ মার্চ তারা আমার স্বামীর ব্যবসা প্রতিষ্ঠানেও হামলা চালায়। তারা আমার স্বামীকে মারধর করে এবং দোকানের ক্যাশ বাক্স থেকে প্রায় ৬৩ হাজার টাকা লুট করে।"

শবনম খান অভিযোগ করেন, "এ সব ঘটনায় থানায় মামলা হলেও আসামিরা প্রকাশ্যে ঘুরে বেড়াচ্ছে। বাবা ওসমান বিহারী বলে বেড়াচ্ছেন, তিনি পাল্টা মামলা দিয়ে আমাদের জেল খাটাবেন।"

শবনম খান বলেন, "যুদ্ধাপরাধীদের বিচার ও গ্রেপ্তারে যদি সাংবিধানিক জটিলতা থাকে, তাহলে হামলার ঘটনায় ওসমান বিহারীকে গ্রেপ্তার ও বিচার করতে সাংবিধানিক কী জটিলতা রয়েছে?"

এ বিষয়ে প্রধান উপদেষ্টা ও সেনাপ্রধানের দৃষ্টিও আকর্ষণ করেছেন তিন ভাই-বোন।

এতদিন পর 'যুদ্ধাপরাধী' বাবার বিচার চাইছেন কেন- সাংবাদিকরা প্রশ্ন করলে শবনম খান বলেন, "তার সঙ্গে আমরা সম্পর্ক রাখিনি। তবে আজ যুদ্ধাপরাধীদের বিচারের দাবি সারাদেশে জোরেশোরে ওঠায় আমরাও বাবার বিচার চাইছি।"

ওসমান বিহারীর বাড়ি শহরতলীর মাদলা গ্রামে। তিনি এক স্ত্রী ও সন্তানদের নিয়ে সেখানে থাকেন। বগুড়া নিউমার্কেটের ওসমানিয়া ক্লথ স্টোরসহ কয়েকটি দোকানের মালিক তিনি।

তার প্রথম স্ত্রীর সন্তান শবনম হকরা বগুড়া শহরেই থাকেন। তাদের মা মারা গেছেন।

ওসমান বিহারীর বিষয়ে জানতে চাইলে মুক্তিযুদ্ধের অন্যতম সংগঠক ও প্রবীণ আওয়ামী লীগ নেতা এ কে মজিবুর রহমান বিডিনিউজ টোয়েন্টিফোর ডটকমকে বলেন, "ওসমান বিহারী ছিল চিহ্নিত রাজাকার। দেশ স্বাধীন হওয়ার পর সে বগুড়া থেকে পালিয়ে যায়। শুনেছি, ওই সময় সে ঢাকায় আত্মগোপন করে। '৭৫ এ বঙ্গবন্ধু হত্যাকাণ্ডের মাধ্যমে রাজনৈতিক পটপরিবর্তনের পর সে এলাকায় ফিরে আসে।"

সন্তানদের অভিযোগের বিষয়ে যোগাযোগ করা হলে ওসমান বিহারী বিডিনিউজ টোয়েন্টিফোর ডটকম- এর কাছে সব অভিযোগই অস্বীকার করেন।

তিনি কোনও হামলায় জড়িত ছিলেন না বলেও দাবি করেন।

যুদ্ধাপরাধের বিষয়ে প্রশ্ন করা হলে তিনি বলেন, "আমি শান্তিপ্রিয় মানুষ। একাত্তরে শান্তিপ্রিয় ছিলাম, এখনও শান্তিপ্রিয় আছি।"

স্বাধীনতার পর আত্মগোপণের বিষয়ে ওসমান বিহারী বলেন, "স্বাধীনতার পর কিছুদিনের জন্য ঢাকা ছিলান। অন্য কোনও বিষয় নয়, ঢাকায় থাকতে ভালো লাগছিল বলেই সেখানে ছিলাম।"

Tying criminal code with tax code is problematic. However well intentioned those rules are, they usually do not serve the purpose, those usually backfire.

To quote from the following Financial Express news item - "He (the finance adviser) said the government will allow disclosure of all legally earned untaxed income under the existing law provided owners of the same are not facing any criminal charge."

The question that we want to ask is this: If someone is facing criminal charge, can she or he still have legally earned untaxed income? Yes, it is possible that this person have some untaxed income that was legally earned, but not previously declared. If that is the case, then, why would the law that the finance adviser talks about would not be deemed against the basic premise fairness and equality in legal rights?

I know what some of you or even the finance adviser may opine. "Eto kisu kore tu para jabe na" or "Criminal der abar constitutional right ki?" But these type of opinion is not helpful if we are really interested about developing a system that works, rather than being an ideal system. May be we can punish people with that attitude, but in the long run those kinds of law wouldn't pass the test of time. They also do not serve the purpose of building a better future.

One thing that our policy makers and the government agencies do not understand is that being in the position of responsibility - being a part of the government is one of the most difficult thing. If you want to ban something (such as block certain citizens from certain rights under the law), you have to be able to prove those allegations beyond doubt. If you can not ascertain an income as illegal beyond doubt, you have to consider it as legal (even if it might be the case!). Off course, it is also the responsibility of the government to keep investigating so that any illegal things are found. Until and unless that can be done, you have to learn to "let things to go".

Bottomline: Law enforcement have to start with a presumption that a citizen is always innocent until it is proven otherwise in the court of law and his or her assets are all legal until it is proven in the court otherwise. Doing one thing wrong does not prove that the person has done other things wrong. Each of the cases has to be proven separately and the person himself or herself has to be dealt with fairness and respect.

In doing that the authorities will have to let many things go untouched. But if you can catch few percent beyond doubt, that should be your starting point. Build capacity within the system that increases the initial success rate (the small percent) over the years. That way success might be slow, but it will be sure and stable. More importantly, it will not effect the economy adversely or the adverse effect will be much less than positive impact of the activities which wasn't the case during last few months.

A first important step in achieving that economic stability and confidence, NBR has to be made a blind organization. Let other agencies deal with criminal matters, not the NBR. Essentially, NBR is selling a product which is government service. This is a promise of future government service that NBR sells to the citizens - a promise to treat the people with respect and give every possible protection that the citizens needs from the State. Selling of that promise can not be successful unless NBR itself becomes more respectful to the individual rights of the citizens, no matter what kind.

Penal tax on legalisation of undisclosed income likely to be rationalized

The government is planning to reduce the large gap between the highest and the lowest rates of penal tax levied at the time of legalisation of untaxed income, said Finance Adviser Mirza Azizul Islam Sunday.

The lowest rate of penal tax is now 10 per cent and the highest 250 per cent for a taxpayer wanting to legalise his or her lawfully earned undisclosed income.

"Taxmen want to fix the penal rate at higher level while the taxpayers want the same at the lowest level. We are exploring ways to minimise the gap," Islam said in a pre-budget meeting with the editors of print and electronic media held at the conference room of the National Board of Revenue(NBR).

He said the government will allow disclosure of all legally earned untaxed income under the existing law provided owners of the same are not facing any criminal charge.

The National Board of Revenue (NBR) arranged the pre-budget meeting which was presided over by its chairman Muhammad Abdul Mazid.

Prior to the exchange of views on the budget for the next fiscal, the Finance Adviser unveiled the Annual Report-2006-07 of NBR and a few recent NBR publications prepared to motivate the eligible taxpayers to pay tax in large numbers.

On continuation of the tax holiday facility, Islam said the volume of investment against the tax holiday facility was not that high in the past few years.

"We are exploring various options relating to tax holiday. The facility may be continued for next couple of years or it may be revised"," Islam said.

The Finance Adviser said the government would reduce the discretionary power of the taxmen further in the next fiscal budget.

"We have already curtailed some discretionary power of the taxmen in the budget for the current fiscal and it will be further reduced in the next budget," he said.

Editors taking part in the discussion said that the government must simplify further the tax payment procedures and ensure that taxpayers are not harassed by the tax officials.

Matiur Rahman Chowdhury, Editor of the Manabjamin said tax payment system should be more simplified to encourage taxpayers to come under tax net.

Mr Bahauddin, Editor of the Inquilab suggested the NBR to use the services of religious leaders in motivating the people to pay tax.

Deputy Editor of The Financial Express Shamsul Huq Zahid said it is widely believed that the 'fear factor' played an important role in higher collection of income tax during the current fiscal year. He wanted to know whether the same factor would contribute to higher revenue earning under an elected government in the next fiscal.

Faridur Reza Sagar of Channel I said: "The government could raise awareness among the taxpayers through sending SMS."

Shaymal Dutta, Editor of the Bhorer Kagoj said the NBR should adopt a professional approach in its campaign to motivate the taxpayers.

Federation of Bangladesh Chambers of Commerce and Industry (FBCCI) president Annisul Huq said the business associations could help the board raise number of TIN holders by 25 per cent if a conducive environment could be ensured at the field level tax offices.

Mr. Alamgir Mohiuddin, Editor of the Naya Diganta also spoke on the occasion.

The NBR held a series of meetings in the past few days with 22 business associations and received a number of recommendations from the latter.

The NBR chairman said the board would hold a pre-budget meeting on April 24 with the FBCCI to finalise the recommendations.

NEW DELHI, APRIL 14: Ahead of this week's official April forecast for the monsoon by the India Meteorology Department (IMD), the US-based International Research Institute for Climate and Society (IRI) has said there is hope for good rains in the first half of the four-month monsoon season beginning June. The rainfall intensity may taper off in the last two months of the season.
 
The IRI map shows that in the first two months of the monsoon season, there will be good rains in the southern peninsula and parts of central India. In August-September, apart from peninsular India, there will be good rains in Gujarat and parts of Rajasthan and in the plains of the eastern Himalayas.
 
There is only a distant possibility of the spoilsport El Nino (warming of the Pacific water above normal) emerging in the period in the Nino 3.4 region — the region in the Pacific which influences Indian monsoons. In fact, the IRI sees the presence of the opposite phenomena La Nina (cooling of the Pacific waters below normal). Historically, La Nina causes good rains.
 
But La Nina is on a weakening trend. According to IRI, the 85% to 75% probability of La Nina in April and May would come down to 60% to 50% in June, the first month of the monsoon season. In July, the probability estimate remains in the range of 50% to 40%. In September, the last month of the monsoon season, the probability of La Nina would come down to 35% to 30%. But the El Nino factor is seen low at 5% to 20% in the monsoon period, while neutral condition could range from 5% to a maximum 50%.
 
Given the gradual decline of the La Nina factor, the good rains in the first two months of the monsoon season may taper off towards the end. There is also a possibility of early arrival on the southwest monsoon, sometime in May due to the higher influence of the La Nina factor. The IRI is slated to update its forecast on April 17.
 
But the US-based Climate Prediction Center (CPC) of the National Centers for Environmental Prediction (NCEP), confirming the gradual decline of the La Nino factor, said: "La Nina is expected to continue for the next three months... Nino 3.4 region indicate La Nina will become weak and persist through May-June-July 2008." La Nina has already caused heavy rainfall over Indonesia.
 
According to IRI, western equatorial Indian Ocean has below normal temperatures while the eastern part has temperatures above the normal. The below normal temperature conditions in western Indian Ocean is likely to weaken slowly.

Good rains expected in SW Monsoon: IMD

New Delhi, April 16: The official weather forecasting agency, India Meteorological Department (IMD) has said that the countrywide rainfall in the four-month monsoon season, beginning June would be 99% of the long period average (LPA) rainfall for the period which is 89 cm.
 
The forecast is subjected to a model error of +/-5%.
 
Making this initial forecast for the South-West Monsoon, IMD said that it would be "near normal" rainfall as it has revised its categorization of rainfall basing on 1901-2005 data. In the revised categorization there is no normal rainfall. Rainfall in the range of 96% to 104% of the LPA is termed near normal, that in the range of 90% to 96% of the LPA is termed below norm and that below 90% of the LPA is termed deficient.
 
Rainfall in the range of in the range of 104% to 110% of the LPA is termed above normal and that above 110% is termed excess.
 
The Union Minister for Science and Technology and Earth Sciences, Kapil Sibal releasing the forecast said, "the presence of La Nina factor (cooling of Pacific waters below normal) would boost the prospects of good monsoon rains. The recent global dynamical and statistical models say that La Nina will become weak but persist for the next three months."
 
The Indian Express and The Financial Express on April 15 quoting IRI data had said La Nina would cause good rains in the first two months.
 
Sibal said that IMD while making its forecast had taken help of both statistical and dynamical models. The dynamical models works well for peninsular India and northeastern region.
 
The leader of the monsoon forecast team, M Rajeevan said that a set of 5 predictors were used for making this initial forecast like North Atlantic sea surface temperature in December and January, equatorial southeast Indian Ocean temperature in Feberuary and March, east Asia mean sea level pressure in February and March, north-west Europe land surface air temperature in January and equatorial Pacific warm water volume in February and March.
 
The IMD would consider another set of 6 predictors while making the final forecast for the season in June. In May the IMD would predict the date of arrival of the South-West Monsoon at the Kerala coast.
 
Global climate change and its impact on Indian weather and monsoons is the issue which Indian meteorologists are exploring to understand. In last March there was unusual heavy rains in the four southern states – Andhra Pradesh, Karnataka, Kerala and Tamil Nadu, causing damage to the standing crops. In Tamil Nadu the rainfall was in excess of 801%, that in Kerala in excess of 469%, that in Karnataka in excess of 1666% and that in Andhra Pradesh in excess of 811%. This year's March rainfall was a all time high record in Tamil Nadu, Karnakata and Kerala since 1875, while in Andhra Pradesh it was the second highest since 1875.
 
There was practically no winter rains over north and northwest India in 2007-08, but there was a sudden spurt of heavy rains and thundershowers in the region on April 4, 2008 leading to cloudy weather for the next three days. In past there has been cases of sudden spurt in day temperatures in early February causing damage to wheat crop....

Evil indeed is their judgment." (16: 57-59) Burying a daughter alive when she is very young was a common practice among them. A daughter was an unproductive member of the family, and she could not fight in the frequent tribal wars that plagued Arabia at the time. On the contrary, she could bring shame upon her family and tribe, if she were to be guilty of immoral conduct. Hence, getting rid of her was, to them, a preferable option.

Right from the first day his first daughter, Zaynab, was born, Muhammad (peace be upon him) was the kindest of fathers. The very name he chose for her is indicative. It is made up of two words, zayn, which means 'ornament', and ab, which means 'father'. So, he called her the ornament or the jewel of her father, indicating how pleased he was to have her. He felt the same with every one of his daughters. He loved them, played with them and gave them the best upbringing. At the time, a woman who gave birth to more daughters than sons was blamed for the fact, and could suffer ill treatment by her husband and his family. Not so in the case of Khadeejah, whose two sons by the Prophet died in infancy. He was a most loving husband who appreciated the fine qualities of his wife and loved her tenderly.

Zaynab married Abu Al-Aas ibn Al-Rabie, a man with fine character and high integrity. However, for nearly 18 years after the start of the Islamic message he remained an unbeliever. His wife had to be separated from him on account of that, joining her father in Madinah in year 2 but reunited with her husband in year 6 when he declared himself a Muslim and joined the Muslims in Madinah.

The Prophet's two daughters, Ruqayyah and Umm Kulthoom, had a similar pattern of life. Both were engaged to two brothers who were cousins of the Prophet, Utbah and Utaybah, sons of his uncle, Abu Lahab. However, when Muhammad started to receive God's revelations and became a Prophet, his uncle took a very hostile attitude to his message. In his opposition, he ordered his two sons to split with the Prophet's daughters. Reports are unclear whether the two marriages were already solemnized. Most probably they were. Thus, the two young women were divorced through no fault of theirs. The only reason was that their father-in-law, the Prophet's uncle, was fiercely opposed to the message his nephew received from on high.

Ruqayyah, the elder of the two, was soon married to Uthman ibn Affan, who was one of the earliest followers of Islam. When the Prophet encouraged some of his companions to immigrate to Abyssinia, Uthman was the first to do so with his wife. Indeed, the couple were the first ever to immigrate for their faith since the time of the Prophet Lot. However, they returned to Makkah after spending a period of time in Abyssinia and joined other Muslims when they immigrated to Madinah a few years later. Tragedy soon hit the young family, and Ruqayyah died at the time of the Battle of Badr, which took place only 18 months after the Prophet's immigration to Madinah.

Uthman keenly felt his grief. He was a very sensitive and shy person. The Prophet once saw him looking very sad. In reply to the Prophet's enquiry, Uthman said: "Has anyone suffered what I have suffered? The Prophet's daughter has died, leaving me shattered, grieving not only for her death but also for the fact that my special relation with you has come to an end." The Prophet felt keenly for Uthman and gave him Umm Kulthoom, his other daughter, as wife. He was the only one privileged to marry two daughters of the Prophet. This earned him the title Dhu al-Noorayn, or the man with two lights.

Umm Kulthoom lived several years with her husband, but again Uthman was to suffer a tragedy when she died in year 9 of the Islamic calendar, i.e. one year before the Prophet passed away. The Prophet, who grieved for Umm Kulthoom, the third of his four daughters to die during his lifetime, also felt for Uthman. He said: "Had we had a third daughter, we would give her to Uthman in marriage."

Fatimah, the Prophet's youngest daughter, was married to Ali, his cousin. Perhaps the Prophet did not love anyone as he loved Fatimah. When he returned from a trip or an expedition, he would call on her before he went home. When she came to visit him, he would stand up to greet her, kiss her and let her sit in his place. People who wanted to speak to the Prophet about a difficult subject, or were too shy to put a request to him, would seek her help in doing so. She would willingly speak on their behalf. In most cases, the Prophet would grant them what they requested, unless it was not allowed in Islam.

Fatimah lived very happily with Ali, giving him his two sons, Al-Hasan and Al-Husayn. She was the only one of the Prophet's seven children to survive him. She, however, was the first of his family to die after he had passed away, with barely six months separating their deaths. Thus, none of the Prophet's four daughters lived to reach forty years of age. May God bless their souls.
